An Open Letter to the Everyones Internet Family of Customers and Employees

Dear Friends:

Yesterday, a guest on the O’Reilly Factor on Fox News made certain misleading statements about our company, including that we have a history of supporting terrorist and white supremacist websites.

Mr. Jeremy Reynalds appeared on the O’Reilly Factor to discuss Mawsuat.com, an Islamic website that is not and has never been hosted at EV1. Recently Mr. Reynalds persuaded Mawsuat.com’s hosting provider to remove the site. Subsequently, he received threats in the form of bulletin board posts on Ansarnet.ws.

At the time, the Ansarnet.ws bulletin board was hosted by EV1. However, our Abuse Department received notification of the posts, and terminated service to Ansarnet.ws after reviewing its content. This took place approximately two weeks ago.

To better understand our position, there are a few things you should know. EV1 manages over 20,000 dedicated web servers, which together contain more than one million websites. In January, more sites chose to host with EV1 or one of our resellers than any other hosting company in the Americas.

Our primary role in the web hosting industry is that of a wholesaler. We lease entire web servers to resellers, who use this equipment to offer hosting services to individual website owners. Many of our servers are home to several hundred websites. And many of these websites are public forums which are open to input from any number of participants.

Our company, operating according to established industry practices, does not pre-screen resellers. We also do not review individual websites that resellers add to their servers. Or content that site owners or their visitors post on their websites. It would be impractical and unreasonable for us to monitor and censor all communications that take place on our network. More importantly, we do not have the legal or ethical authority to do so.

However, while we don’t act as a real time censor, we have always been committed to being good Internet citizens. Our Abuse Department operates 24/7 to investigate and address any complaints against any server or website on our network. We will cease to host any content that violates our terms of service or acceptable use policy. This is enforced without regard to revenue generated through any particular customer. Incidentally, given our role as a wholesaler, a vast majority of the individual websites against which we have received complaints have been customers of our customers, whose presence on our network has a negligible, if not nonexistent, impact on our revenue.

We also cooperate fully with law enforcement agencies whenever requested. On some occasions, we have been asked to terminate a user’s service. On others, we have been forbidden from interrupting the operations of certain websites – even when the customer has long past-due payments. We have also received subpoenas and court orders to preserve copies of customer data, or seize entire hard drives. In all cases we endeavor to comply with each agency’s requirements. However, we are not always in a position to disclose details of these requests.

I want to assure you that we at EV1 take our responsibilities very seriously. As always, we will promptly address any complaints against any content hosted within our facilities. Should you have any questions or comments about our policies, please don't hesitate to contact me at headsurfer@ev1.net. Thank you.
