Terms & Conditions - Need Advice

Hi all,

I've created an affiliate site to market a reverse phone search service online.

My site has a search feature that was provided by their affiliate tools which means users can essentially make a search and purchase the product (ie the search results) via my website.

This is different from the other affiliate sites I have made where I am only promoting the product and not effectively providing it...

So does this mean my Terms and Conditions have to be the same as the terms and conditions the merchant provides on his/her website?

Usually I would just look at another affiliate and see what they are doing with their terms and use their strategy or one similar, but I cant seem to find another affiliate marketing the same program.

What should I do?

Can I get sued if I make a mistake?

I'm not a lawyer and don't have any expert advice at all on this but here are my thoughts.

1st it does not seem like reverse phone lookup service has much risk of lawsuit but I don't know that industry. Would think if you customized whatever the merchant has for a TOS basically saying service is not guaranteed, you can't sue us for x,y,z or whatever.
