If they are totally uncontactable there really isn't much you can do. It could be that the orginal dev has died or moved away. It's bad planning really and if you can't get access to anything you going to be in for a hard time.
 
It all would depend on the original contract that the client signed. I think the Dev would have a hard time claiming any rights over the user data so he really should let you have access to that as a minimum.
 
Hi John, you'd need to get your client to look back over the contract with his developer/host. If as you say he could host it anywhere provided he did not sell on the code to a third party, then there should be no problem.

If the Dev is UK based then English trading laws would be relevent, if not then the country where the Dev lives is where the law applies. I know this might help much, but which ever countries law apply it's the original contract that is going to be needed.

Question how does he back up his database ? from the admin backend management.

A solicitors letter might be the best answer even if the client does not want to go down a legal route.

Try sending a politely worded registered letter. They'd have to sign for it, so you'd know they received it.
