So after an initial outburst of SMS marketing i now here the phone networks are coming down hard on advertisers? Anyone have any input?

It really depends on how you are doing your SMS marketing. The PIN submits and stuff like that are about to be completely banished because there are so many unethical marketers who don't disclose the proper information, but there's still ample opportunity to be compliant and do SMS the right way.

I think it was more to do with marketers gathering phone numbers and spamming mobile inboxes via sms!

It's all a trade-secret. But as far as the USA, if you do it the right way - you can easily do it. As well as internationally.
But for anyone reading this, the SMTP method ex- xxx-xxx-xxxx@gateway.tld - ex: 123-456-7890@txt.att.net that is completely and utterly against the FTC/FCC regulations. Be forewarned, that if you do it you can get charged up to $100 per text message sent(depending on the decision of the court and cell phone companies).
