Google this week lost an initial attempt to gain sole control over the Gmail trademark in Switzerland, but the search giant said the ruling would not force it to rename its e-mail service there.

The Zurich Commercial Court on Monday dismissed Google's arguments in a lawsuit challenging a trademark registered by German venture capitalist Daniel Giersch, who runs an electronic postal delivery business in Germany and Switzerland that goes by the name G-mail (short for "Giersch mail").

The Mountain View, Calif.-based corporation had argued that Giersch had registered the name in bad faith, but the Swiss court disagreed. Google plans to file an appeal.

That's clear case, In my opinion Google lost and decision seems to be right. It is clear violation of Trademark laws. They should stop using gmail name

But I bet you it can be settled outside of courts with the right $$$

That sure makes me lose a ton (tonne) of respect for Google. They are trying to take what isn't theirs, in fact, the Swiss fella should get the rights to gmail world wide, and Google should find another name....Just because they are giants shouldn't give them the idea that they can just take and have anything they want......Google is wrong.
 
Big companies always like to bully little people and small businesses. They had exactly the same problem with gmail.co.uk but the small business that owed gmail.co.uk is not too small, they offered it to Google under license, Google refused and instead called Gmail in UK Googlemail.

Same with the EasyJet.com people, if you start any company with the word "Easy" in it their lawyer will be on to you as it the word "Easy" was created by them. The recently took a guy who started a pizza company called "EasyPizza" to court and lost over this. Thank god there is still some justice for little people.
 
still on the subject of big company trampling on smaller companies ID read this about Microsoft:

A company called Office Live said Friday it has filed a trademark infringement lawsuit against Microsoft over the software giant's use of "Office Live" for its on-demand productivity tools.

Office Live, which runs sites such as Legalofficelive.com, Realtorsofficelive.com and Accountantsofficelive.com, offers free professional advice to consumers and offers customer leads to businesses. The company is seeking an injunction to prevent Microsoft from using the "Office Live" name.
