Bill Introduced to Address Affiliate Tax

After months of debate and discussion, the issue of affiliate taxation is once again being considered on a federal level. Kentucky Senator Jim Bunning introduced a bill in late October that would eliminate affiliates from the definition of physical presence within a state.
This bill, if passed, would prevent states from assessing a tax on out-of-state-merchants if the only revenue-sharing connection is affiliates. Bill S. 3670 has a sponsor and has moved on to Committee on Commerce, Science and Transportation.

Now is the time for all affiliates and merchants to contact their senators about this important issue. We need to make sure our representatives understand that this is not just an issue in New York state. All states need to address affiliate taxation.

Make no mistake about the stakes. If this bill fails to pass, affiliate taxation will be decided on a state level. This may be our last chance to win this debate on a national level. With one bill, affiliate taxation could be resolved. If not, the battle will be fought time and time again within each state.
